Tax agents play an important role in the administration of the tax system. The regulation of tax agents is aimed at protecting taxpayers by ensuring that persons who charge a fee for providing tax agent services are fit and proper persons to be registered as tax agents. This includes knowledge of Australian income tax law and relevant accounting principles.

The Tax Agents Board is responsible for determining the suitability of applicants to be registered as tax agents, and ensuring that proper standards are maintained across the tax agent profession.

A tax agent must be registered to act on behalf of a taxpayer and charge a fee to provide tax agent services.

Tax agent services are:

  • preparing or lodging a return, notice, statement, application or other document about their liabilities under a taxation law
  • giving advice about a taxation law
  • preparing or lodging an objection against an assessment, determination, notice or decision under a taxation law
  • applying for a review of, or instituting an appeal against, a decision on such an objection, or
  • dealing with the Commissioner or a person who is exercising powers or performing functions under a taxation law.

Professionals charging for tax services while not registered as a tax agent constitutes a criminal offence and could, when uncovered, require the Australian Taxation Office to perform and audit of your taxation affairs.
